Trump Slams Weak Supreme Court

( Former President Donald Trump used part of his first post-White House speech to blast the Supreme Court for not “doing anything about” the 2020 presidential election that he says was “rigged.”

Speaking at the Conservative Political Action Conference this weekend, Trump railed on the “sick and corrupt” process that is America’s elections. He specifically referred to the Supreme Court’s refusal to even hear Republican challenges to some state courts that ultimately changed their voting rules right before last fall’s election.

He said:

“This election was rigged and the Supreme Court and other courts didn’t want to do anything about it. They didn’t have the courage, the Supreme Court. They didn’t have the courage to act, but instead used process and lack of standing.”

Just last week, the Supreme Court voted that they wouldn’t hear a case from Republicans that said the state government and courts in Pennsylvania circumvented their state legislature when it decided to change the rules for voting deadlines and mail-in ballots.

The high court ruled 6-3 that they wouldn’t hear the case because the 2020 presidential election was over, and therefore, the point was moot. Back in October, when the Supreme Court was split 4-4 following the passing of Justice Ruth Bader Ginsburg, the court allowed Pennsylvania’s voting law changes to stand, with the court voting 4-4 not to block to the voting deadline extension.

Republicans filed appeals that asked the Supreme Court to hear the actual cases in question. But, the decision to not hear those cases stretched into February.

The big smack in the face to Trump was that two of his three appointees to the Supreme Court voted against hearing the case. Both Brett Kavanaugh and Amy Coney Barrett voted against hearing the case, while Neil Gorsuch voted in favor of hearing the case.

Trump said the Supreme Court should be “ashamed of themselves” for the decisions they made. He said:

“They didn’t have the guts or the courage to make the right decision. They didn’t want to talk about it.”

In his speech, Trump also talked about a case brought by Ken Paxton, the attorney general in Texas, which the Supreme Court also refused to hear. He said:

“Our election process is worse than that in many cases of a third-world country. You know that. You saw what was going on. Even if you consider nothing else, it is undeniable that election rules were illegally changed at the last minute in almost every swing state with the procedures re-written by local politicians.

“Regardless of your political views, this should concern you as a constitutional matter. And the Supreme Court, again, didn’t have the guts or the courage to do anything about it. And neither did other judges. And Democrats even admitted in Time magazine.”

That last comment was a reference to a Time article that says a “cabal of powerful people” did work behind the scenes to “influence perceptions, change rules and laws, steer media coverage and control the flow of information.”
